When using personal data for marketing, you need to comply with the General Data Protection Regulation (GDPR). For some marketing activities, you also need to adhere to the EU’s ePrivacy Directive. In the UK this was implemented as the Privacy and Electronic Communications Regulations (PECR).
Are you sending out direct marketing? Then GDPR and PECR are interlinked:
- GDPR governs the processing of personal data of EU citizens. But you don’t always need consent to process data.
- PECR governs direct marketing by electronic means including marketing calls, texts, emails and faxes. You must have consent to process data, unless the soft opt in rule applies.
There are also other privacy data considerations relating to marketing and data protection compliance in both B2B or B2C marketing activities.
